GENERAL AREAS TO BE  COVERED

1) Role and general duties of a registered estate agent. Discussion on both the law and the practical practice Considering:

(a) Valuers, Appraisers And Estate Agents Act 1981
(b) Contracts Act 1950
(c) Malaysian Estate Agency Standards (isued by the Board Of Valuers, Appraisers, Estate Agents And Property Managers) including the types ‘of appointment and the standard forms proposed

2) What is a legally binding contract in Malaysia.
Considering Contracts Act 1950 and case authorities.

3) Practical issues in sale and purchase transactions including considering :-

(a) freehold and leasehold land (including on extension of leasehold land)
(b) restrictions in interests
(c) conditions of title
(d) indefeasibility of title
(e) caveats (private caveat, registrar’s caveat, lienholder’s caveat and caveat)
(f) general discussion on how the registered agent can play a role in assisting a smooth and successful completion of the sale and purchase transaction

4) Practical issues in tenancy transactions including considering

(a) tenancy and lease – the differences
(b) some general terms and conditions
(c) general discussion on how the registered agent can play a role in assisting a smooth and successful tenancy or lease agreement

5) General discussion on other applicable issues including :-

(a) Real Property Gains Tax
(b) Stamp Duty
(c) Other costs involved in property transactions
